The screening and verification process is used for every applicant the same way—fairly, consistently, and uniformly.  We work every diligently to observe both the spirit and the letter of the fair housing laws—not just because they are the law of the land, but because we sincerely believe, personally and as a company, in fair housing and equal opportunity for everyone.

 

An applicant who passes the eligibility process will be notified in writing, when a suitable apartment becomes available.  An applicant who does not meet the eligibility guidelines will not be considered as a potential tenant. By making an application for an apartment at Country Way Apartments in Junior, WV, you acknowledge that these checks and verifications will be completed, and give your permission for us to do so.  Eligible applicants chosen to become tenants will be required to submit a security deposit and key deposit prior to becoming a County Way Apartments tenant.

All applicants will sign release forms allowing the manager to receive information on income and bank deposits, assets, student status, obtain credit reports, criminal record checks, and other information required to determine eligibility.  The applicant will be advised that a decision on eligibility cannot be made until all verifications are complete.

 

The manager will investigate the references and previous landlords and other eligibility criteria to determine if the applicant is eligible or ineligible for housing at the property.

 

The applicant will be notified in writing if the application cannot be processed because it is incomplete.  The applicant will be given 10 days to respond and complete the application. Applicants that do not provide the requested information within the 10 day period will not be considered for placement as a tenant.  At such time that all requested information is provided, eligible applicant will be placed on the waiting list if the waiting list period is open. Verifications for eligibility cannot be over three months old.  Applicants will be asked to submit proofs of current verifications to determine eligibility.

 

North Central WV Community Action Assoc. Inc. adheres to all Fair Housing and Equal Opportunity requirements.  Discrimination based on race, color, religion, creed, sex, age, national origin, familial status, handicap, disability, sexual orientation, gender identity, and marital status is prohibited.[/vc_column_text][/vc_tta_section][vc_tta_section title=”Eligibility” tab_id=”1547059549754-3c36ca0d-7d82″][vc_column_text]Annual household gross income at initial leasing must be twice the monthly proposed rent of the apartment unit to show that income is sufficient to maintain the rent plus utilities. At initial lease, two units must be rented to households with incomes at or below 50% of the area median income, based on household composition for Barbour County, and the remaining units may be rented to households with incomes at or below 65% of the area median income, based on the household composition for Barbour County. Income limits may be reviewed in the rental office.  If, after completing the lease agreement the family income should exceed 80% of median income, the family will be required to pay 30% of their income for rent and utilities.

 

Country Way Apartments contains a one bedroom unit that is handicapped accessible.   Applicants who apply for that unit will be required to provide documentation certifying they have a need for the accessibility features of the unit.

 

The Home program adopts the Section 8 Housing Choice Voucher (HCV) program restrictions on student participation found at 24 CFR 5.612, which exclude any student that:

 

1.  Is enrolled in a higher education institution

2.  Is under age 24

3.  Is not a veteran of the U.S. military 

4.  Is not married

5.  Does not have a dependent child(ren)

6.  Is not a person with disabilities

7.  Is not otherwise individually eligible, or has parents who, individually or jointly, are not eligible on the basis of income.

 

Excluded students are prohibited from receiving any type of HOME assistance, including renting HOME-assisted rental units, receiving HOME tenant-based rental assistance, or otherwise participating in the HOME program independent of their low or very low income families.[/vc_column_text][/vc_tta_section][vc_tta_section title=”Verifications” tab_id=”1547059725186-3f57646b-8429″][vc_column_text]The rental applicant must provide a valid social security card and birth certificate for all household members on the rental application.  The manager will photo copy the original social security card and birth certificate.

 

If upon request, the applicant is unable to provide a social security card for each household member listed on the rental application, the applicant must sign a release form for a third party verification of the social security number(s).  [/vc_column_text][/vc_tta_section][vc_tta_section title=”References” tab_id=”1547059768674-e4e0cd35-fcef”][vc_column_text]The applicant will be asked to provide the management with at least two landlord references.  However, lack of credit or landlord history (as opposed to a poor credit/landlord history) is not sufficient justification to reject an applicant.

 

When an applicant cannot supply the management with the preferred references, the applicant will be asked to name two personal references.  A personal reference must be someone who is

 

not related to the applicant by blood or marriage and who has known the applicant for the past three to five years and is aware of the applicant’s living conditions.  The personal history will involve past performance in meeting financial obligations, record of disturbances, destruction of private property and living and housekeeping habits.[/vc_column_text][/vc_tta_section][vc_tta_section title=”Screening Criteria” tab_id=”1547059821404-1a1ecc4d-0f09″][vc_column_text]Only applicants who have satisfactory past performance in the following will be considered as tenants:  (1) meeting financial obligations, especially rent payments, and utility payments, (2) satisfactory rental history and no record of disturbances of neighbors, destruction of property, or living or housekeeping habits at prior/present residence which may have an adverse effect on the health, safety or welfare of other tenants; and (3) who do not have history of violent physical

crimes to people or property, which would have an adverse effect on the health, safety or welfare of other tenants.

 

If, after admission of the applicant a prior conviction or violent criminal activity, drug related criminal activity or conviction of a felony becomes known, the tenant will be subject to eviction through the eviction process.  The tenant will also be subject to eviction for failure to disclose such conviction.    [/vc_column_text][/vc_tta_section][vc_tta_section title=”Credit Report” tab_id=”1547059864926-184a3172-784b”][vc_column_text]The rental applicants’ credit report will be used to review the applicants’ utility payment history.[/vc_column_text][/vc_tta_section][vc_tta_section title=”Criminal Record” tab_id=”1547059905468-a911479b-e7f9″][vc_column_text]The manager will check with law enforcement officials, including the appropriate City, Circuit and District Courts, and the Administrative Office of the Courts for any information they may have regarding the applicant. 

 

An unsatisfactory police report shall be considered as a basis for rejection of an application when any or all of the following conditions exist:

 

1.                 The applicant or any of the applicant’s household members have been charged

and convicted of a crime within seven (7) years preceding the application date that has been defined by the judicial system as a felony unless the applicant is supervised by an appropriate law enforcement official and is participating in a treatment plan, and/or;

2.                 The applicant or any of the applicant’s household members police report

indicates habitual convictions of a less serious nature, such as driving under the influence, driving while intoxicated, public intoxication, destruction of private property, disturbing the peace, possession of controlled substances or drugs for personal use within five (5) years preceding the application date unless the applicant is actively participating in a generally recognized treatment program and/or;

3.                 The applicant or any member of applicant’s household members has been arrested and convicted for a violent criminal activity (defined as any felonious criminal

activity that has as one of its elements the use, attempted use, or the suspected use of physical force against the person or property of another) or a drug related criminal activity such as the illegal manufacture, sale, distribution or possession with the intent to manufacture, sell, distribute or use a controlled substance as defined in Section 108 of the Controlled Substances Act (21 U.S.C. 802) will be considered as a basis for rejection for an indefinite period.   

 

The manager will check the National Sex Offender’s Registry for all members of the applicant’s household.  Any applicant or member of the household found to be on this registry will result in the application being rejected for tenancy.[/vc_column_text][/vc_tta_section][vc_tta_section title=”Occupancy Standards” tab_id=”1547059961178-a3e04d21-78a3″][vc_column_text]Tenants are only eligible for apartments properly sized to their family.  One bedroom apartments accommodate 1-2 family members, two bedroom apartments accommodate 1-4 family members and three bedroom apartments accommodate 3-6 family members.  If there is an increase or decrease in household size, tenants will be responsible for informing the manager of the change and must submit an updated application to the manager within ten (10) business days after the household size has changed.

 

Once the updated application is received the tenant will be placed on the waiting list for the appropriate size unit, based on the new household size, and given first preference when the appropriate size unit is available.[/vc_column_text][/vc_tta_section][vc_tta_section title=”Unit Transfer” tab_id=”1547059964823-22cc3c5e-e7f3″][vc_column_text]Unit transfers will be allowed due to changes in family composition or medical reasons.  The current tenant is required to submit an application for the apartment and will be placed on the waiting list for the appropriate size unit. [/vc_column_text][/vc_tta_section][vc_tta_section title=”Waiting List” tab_id=”1547060043845-59fad7aa-c50f”][vc_column_text]The manager will maintain a list of applications.

 

Upon receiving an application, the manager will put the time and date of submission on the front of all applications for rental housing when submitted as a completed application.  The waiting list will be maintained as follows:  Applicants will be put on a waiting list according to preference listed in the Tenant Selection portion of the management plan and separate waiting lists will be maintained for each unit size.  A ten-day appeal period applies if an applicant receives a rejection notice.

 

Announcements for opening and closing of the waiting list will be advertised in the Barbour Democrat and the Elkins Inter-Mountain and flyers will be distributed to the Barbour County Department of Health & Human Resources, the Barbour County Family Resource Network and Heart & Hand House, Inc., other social service agencies and others as appropriate.

 

The manager will announce the opening of the waiting list when it is deemed to have insufficient applicants on the waiting list to maintain full occupancy, and may suspend acceptance of complete applications if the waiting list is deemed to be more than one year.

 

Applicants on the waiting list who are contacted when a unit becomes available will be required to resubmit a new rental application if the one on file is more than twelve (12) months old and sign new releases for verification of eligibility that are more than three (3) months old.  Verification of information will be completed upon selection from the waiting list.[/vc_column_text][/vc_tta_section][vc_tta_section title=”Denial” tab_id=”1547060045389-5fe80e64-14d1″][vc_column_text]An applicant found not to be qualified for tenancy by the management will be informed in writing of the reason they will not be accepted.  An applicant who is not accepted for tenancy

upon initial application may reapply if circumstances change enabling them to meet the screening criteria.  Repeat applicants are subject to the full screening process.

 

If the application is incomplete, the applicant will be informed what information is lacking and be given ten (10) days to provide the information.  Failure to provide the requested information within the ten (10) days will result in automatic denial.

 

Rental applicants’ will be denied for the previously mentioned conditions found on any criminal background check, for insufficient income, unsatisfactory rental history with a history of late payments and/or a history of excessive disturbances, destruction of private property;  for any utility history that contains a termination, unless there are justifiable, extenuating circumstances, and for a utility history in which six (6) or more of any utility payments have been ninety (90) days late.
